This Site and the Services are not designed for or directed at children 13 years of age or younger. In addition, in order to enter into this Agreement, you must be 18 years old or have otherwise reached the legal age of majority in your jurisdiction of residence or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in this Agreement, and to abide by and comply with this Agreement. You may not use the Services and may not accept this Agreement if (a) you are not of legal age to form a binding contract with Tableberg, or (b) you are a person barred from receiving the Services under the laws of the United States or other countries including the country in which you are a resident or from which you use the Services.<\/p>\n\n\n\n
Before you continue, you should print or save a local copy of this Agreement for your records.<\/p>\n\n\n\n
In order to access certain Services, you may be required to provide information about yourself (such as API, identification or contact details) as part of the registration process for the Service or as part of your continued use of the Services. You may also have to create passwords or other forms of authentication. You agree to provide true, accurate, current and complete information about yourself, and you may not misrepresent your profile information. You agree and understand that you are responsible for maintaining the confidentiality of any such information or passwords. Accordingly, you agree that you will be solely responsible to Tableberg for all activities that occur under your account. If you become aware of any unauthorized use of your password or of your account, you agree to notify Tableberg immediately.<\/p>\n\n\n\n
Your right to access and use the Services is personal to you and is not transferable by you to any other person or entity. You agree not to disclose your password to any third party. You are solely responsible for all activities that occur under your Account or under your Profile Information. If you become aware of any unauthorized use of your Account or Profile Information, you are responsible for notifying Tableberg immediately.<\/p>\n\n\n\n
By providing us with your e-mail address, you agree to receive all required notices electronically to that e-mail address. It is your responsibility to update or change that e-mail address, as appropriate.<\/p>\n\n\n\n
You shall pay all fees specified in any subscription to Services or use of the Site (\u201cSubscription\u201d). We will charge you a periodic fee based on the Subscription you choose. Such fees shall be billed in advance for each period and are non-refundable except as specifically mentioned in these Terms of Service. Except for refunds provided for cancellation of Subscriptions within the first fourteen (14) days (as described in the section below entitled Cancellation and Termination and in the Tableberg Refund Policy), there will be no refunds or credits for partial months of service or for periods in which your Subscription remains active but you do not use the Services<\/p>\n\n\n\n
We reserve the right to modify our billing rates at any time upon thirty (30) days written notice by posting such fee changes to the Services or on the Site.<\/p>\n\n\n\n
At our discretion, we may offer free or discounted pricing for use of the Services (a \u201cTrial Program\u201d). Once the terms of any Trial Program have expired, you agree that our normal billing rates shall apply. You agree to comply with any additional terms, restrictions or limitations (including limitations on the total amount of usage) we impose in connection with any Trial Program. You may not sign-up for multiple Accounts in order to receive additional benefits under any Trial Programs.<\/p>\n\n\n\n
You agree to pay all charges incurred by users of your credit card, debit card, or other payment method used in connection with your Subscription at the prices in effect when such charges are incurred. You will pay any applicable taxes, if any, relating to any such purchases, transactions or other monetary transaction interactions.<\/p>\n\n\n\n
All prices listed, fees, charges and refunds are issued in USD. We make no guarantees as to the exchange rate between any currencies, or that the exchange rate will remain unchanged during any period of time. The cost of Services may increase or decrease over a given period of time depending on the currency you choose to pay with and the specific exchange rate at that time. Refunds are likewise issued in USD and are subject to exchange rate volatility. There will be no additional refunds or credits issued in consideration of current or eventual exchange rates. You are responsible for any currency exchange taxes, fees, or other costs that may incur by making a purchase of our Services.<\/p>\n\n\n\n
All right, title, interest and ownership and intellectual property rights in and to the Site, Tableberg trademarks and the templates provided via the Site, including but not limited to its \u201clook and feel\u201d (e.g., text, graphics, images, logos, buttons, icons and the placement and layout thereof), images, video, audio, data, content, software (including html-based computer programs) and other media, material or information, other than your Content, are and will remain the property of Tableberg or its software or content suppliers. Any templates or derivatives of templates provided that you may build using the Site belong to Tableberg. The Site is protected under Canada, United States and international copyright, trademark and other laws and treaties.<\/p>\n\n\n\n
Subject to the terms and conditions of this Agreement, Tableberg grants to you, during the term of this Agreement, a non-transferable, non-sublicensable, non-exclusive, revocable, limited-purpose right to access and use the Services that are subject to a valid Subscription.<\/p>\n\n\n\n
You acknowledge that any ideas, suggestions, concepts, processes or techniques which you provide to Tableberg related to the Services, the Site or Tableberg or its business (\u201cFeedback\u201d) shall become Tableberg\u2019s property without any compensation or other consideration payable to you by Tableberg, and you do so of your own free will and volition. Tableberg may or may not, in its sole discretion, use or incorporate the Feedback in whatever form or derivative Tableberg may decide into the Site, its software, services, documentation, business or other products, or any future versions or derivatives of the foregoing. You hereby assign all rights on a worldwide basis in perpetuity to Tableberg in any Feedback and, as applicable, waive any moral rights.<\/p>\n\n\n\n

You agree to safeguard, keep secret and not to disclose to any third party, any Confidential Information acquired, learned or provided from Tableberg during the term of this Agreement or following the expiration or termination of this Agreement. \u201cConfidential Information\u201d means any information marked confidential or that ought reasonably to be considered confidential under the circumstances and includes, without limitation, any business plans, customer lists, operation procedures, trade secrets, design formulas and programming code, know-how and processes, computer programs and inventions, discoveries, and improvements of any kinds.<\/p>\n\n\n\n
Tableberg WordPress plugin is licensed under the GNU general public license (https:\/\/www.gnu.org\/licenses\/gpl.html) version 2.0 or later.<\/p>\n\n\n\n
YOUR USE OF THE SITE AND ALL CONTENT FORMING PART OF OR RELATED TO THE SITE, INCLUDING ANY CONTENT YOU UPLOAD OR SUBMIT AND ANY THIRD PARTY SOFTWARE AND CONTENT, ARE AT YOUR SOLE RESPONSIBILITY AND RISK. Support for Tableberg is provided as long as Tableberg is actively in development. Should any one of the following occur, Tableberg will no longer be responsible for providing support for Tableberg:<\/p>\n\n\n\n

Only a license holder is permitted to request support or access support resources. If any attempt is made by another party other than the license holder to access support in a manner not specified, we reserve the right to suspend indefinitely the license key without notice or consent.<\/p>\n\n\n\n

HOWEVER, THE ABOVE LIMITATIONS WILL NOT LIMIT YOUR PAYMENT OBLIGATIONS UNDER THE \u201cFEES\u201d SECTION OF THE AGREEMENT.
IN NO EVENT WILL EITHER PARTY HAVE ANY LIABILITY TO THE OTHER PARTY FOR ANY LOST PROFITS, REVENUES OR INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, COVER OR PUNITIVE DAMAGES, WHETHER AN ACTION IS IN CONTRACT OR TORT AND REGARDLESS OF THE THEORY OF LIABILITY, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. L'utente rimarr\u00e0 responsabile di tutti gli addebiti maturati sul proprio conto fino al momento del declassamento o della cancellazione dell'Abbonamento, compresi i canoni mensili completi per il mese in cui \u00e8 stata effettuata la cancellazione, fermo restando che se l'utente cancella l'Abbonamento entro i primi quattordici (14) giorni dall'apertura dell'Account Tableberg, ricever\u00e0 il rimborso del canone di Abbonamento.<\/p>\n\n\n\n
In caso di annullamento dell'abbonamento, Tableberg non ha alcun obbligo di mantenere o conservare le informazioni o i contenuti dell'account. Tableberg pu\u00f2, a sua discrezione, cancellare immediatamente le informazioni e i contenuti dell'utente o conservarli (in tutto o in parte) in conformit\u00e0 con i processi e le pratiche di Tableberg.<\/p>\n\n\n\n
Tableberg si riserva il diritto, in qualsiasi momento e senza alcun costo, addebito o responsabilit\u00e0, di rescindere il presente Contratto a sua esclusiva discrezione per qualsiasi motivo, compreso, ma non solo, il mancato rispetto dei termini del presente Contratto. Inoltre, Tableberg pu\u00f2, a sua esclusiva discrezione, in qualsiasi momento, sospendere temporaneamente o permanentemente l'accesso all'account, all'abbonamento o ai servizi per qualsiasi violazione o sospetta violazione del presente Accordo. Tableberg si riserva inoltre il diritto di negare l'accesso a chiunque, compresi, ma non solo, gli utenti che utilizzano server proxy e\/o indirizzi IP residenti in determinate aree geografiche al di fuori del Canada e degli Stati Uniti. La Societ\u00e0 interromper\u00e0 l'abbonamento ed effettuer\u00e0 un rimborso. La richiesta di cancellazione deve essere ricevuta entro 24 ore lavorative dai 14 giorni successivi alla data e all'ora di apertura dell'Account a pagamento. Mentre alcuni rimborsi possono essere immediati, l'accredito del rimborso pu\u00f2 richiedere fino a 5-10 giorni lavorativi per essere visualizzato nell'estratto conto della carta di credito.<\/p>\n\n\n\n
Se non viene ricevuto un preavviso adeguato e la carta di credito viene successivamente addebitata, il cliente non ricever\u00e0 alcun rimborso.<\/p>\n\n\n\n
A volte, Tableberg pu\u00f2 offrire incentivi all'acquisto sotto forma di codici di sconto sull'abbonamento. I codici di sconto sono applicati su base introduttiva, ovvero sono applicati solo per il primo periodo dell'abbonamento selezionato. I codici sconto non si applicano per tutta la durata dell'abbonamento. Dopo il termine iniziale, gli abbonamenti saranno addebitati al prezzo normale.<\/p>\n\n\n\n
In caso di controversia tra l'utente e Tableberg in merito al presente Contratto, al Sito o ai Servizi, l'utente accetta che la controversia sia disciplinata e interpretata in conformit\u00e0 alle leggi dello Stato della Florida, senza tener conto delle disposizioni sul conflitto di leggi. L'utente accetta di sottoporsi alla giurisdizione esclusiva dei tribunali di West Palm Beach, Contea di Palm Beach, Florida, in relazione a qualsiasi rivendicazione, procedimento o azione relativa o comunque derivante dal presente Contratto, dal Sito o dai Servizi, in qualsiasi modo si verifichi, fermo restando che Tableberg pu\u00f2 chiedere e ottenere provvedimenti ingiuntivi in qualsiasi giurisdizione.<\/p>\n\n\n\n
Se una parte del presente Contratto \u00e8 ritenuta illegale, nulla o inapplicabile da un arbitro o da un tribunale della giurisdizione competente, il presente Contratto nel suo complesso non sar\u00e0 considerato illegale, nullo o inapplicabile, ma solo la parte del presente Contratto che \u00e8 illegale, nulla o inapplicabile sar\u00e0 eliminata dal presente Contratto.<\/p>\n\n\n\n
L'utente accetta che il presente Contratto sia specificamente applicabile mediante provvedimenti ingiuntivi e altri rimedi equitativi senza la prova di danni monetari.<\/p>\n\n\n\n
L'utente accetta che se la Tableberg non esercita o non fa valere un diritto o un rimedio legale contenuto nell'Accordo (o di cui la Tableberg ha il beneficio in base a qualsiasi legge applicabile), ci\u00f2 non sar\u00e0 considerato come una rinuncia formale ai diritti della Tableberg e che tali diritti o rimedi saranno ancora disponibili per la Tableberg.<\/p>\n\n\n\n

Salvo quanto diversamente specificato nel presente Contratto, tutti gli avvisi, i permessi e le approvazioni di cui al presente Contratto dovranno essere in forma scritta e si riterranno consegnati al momento: (i) della consegna personale, (ii) del secondo giorno lavorativo successivo all'invio postale, (iii) del secondo giorno lavorativo successivo all'invio tramite fax confermato o (iv) del primo giorno lavorativo successivo all'invio tramite e-mail. Le comunicazioni relative alla fatturazione devono essere indirizzate al contatto di fatturazione designato dall'utente.
